LEGAL NOTICE: 7 DE ADMIN. CODE 1130 SYNTHETIC MINOR PERMIT APPLICATIONS

Notice is hereby given that Ashland Specialty Ingredients G. P. (formerly Hercules, LLC) located at 500 Hercules Road, Wilmington, Delaware, has submitted an application, pursuant to 7 DE Admin. Code 1102, Section 2.1, 11.2.9, and 12.3 to reclassify from a Title V Major Source facility to a Synthetic Minor facility. This reclassification reduces permitted emissions for NOX, VOCs, and SO2 below major source thresholds.

These limits are necessary to restrict Ashland Specialty Ingredients’ potential to emit air pollutants, and the limit will be enforceable by the EPA and the state. Total permitted emissions from the facility are 20.3 TPY CO, 13.3 TPY VOC, 11.0 TPY NOX, 7.6 TPY PM, 2.6 TPY HAP, and 0.7 TPY SO2. This represents a reduction of over 125 tons of permitted emissions per year.

The application, the “draft/proposed” permit (Permit: APC-2017/0044-OPERATION (Amendment 1)(VOC RACT)(SM) ), all materials that the applicant has submitted (other than those granted confidential treatment under DNREC rules), and a copy or summary of other materials, if any, considered in preparing the “draft” permit may inspected at the office of the Division of Air Quality, State Street Commons, 100 W. Water Street, Suite 6A, Dover, DE 19904 or 715 Grantham Lane, New Castle, Delaware 19720. A public hearing concerning the permitting action will not be held unless the Secretary of the Department of Natural Resources and Environmental Control receives a request for such hearing within thirty (30) days from the date of this notice, ending Tuesday, March 12, 2019. A request for a hearing shall be in writing and must show a familiarity with the permit and a reasoned statement of the permit’s probable impact.
