Notification of Public Comment for a Brownfield Development Agreement for the A.M. Domino Jr Salvage Company Site (DE-1173)

Pursuant to the Hazardous Substance Cleanup Act (HSCA), 7 Del. C. Chapter 91, §9126, the Department of Natural Resources and Environmental Control (DNREC) is required to issue a public notice within twenty days after entering into negotiations for a Brownfield Development Agreement (BDA).  A BDA is an agreement between DNREC and a Brownfield developer with respect to a Certified Brownfield Site that sets forth a scope of work and schedule of remedial activities during the development of the Site.

DNREC’s Remediation Section (DNREC-RS) negotiated a BDA with Riverfront Development Corporation of Delaware (RDC) regarding the A.M. Domino Jr. Salvage Company Site (Site), located at 810 South Walnut Street in Wilmington, Delaware.  Identified by as New Castle County as tax parcel number 10-001.00-021, the Site may have had a release of hazardous substances as a result of salvage activities on Site.   

The public comment period begins Monday, July 22, 2019 and will close at the end of the business day (4:30 p.m.) on Monday, August 12, 2019.  Please submit written comments to the DNREC-RS Project Manager, Stephanie Gordon at DNREC-RS, 391 Lukens Drive, New Castle, DE 19720.  A copy of the BDA is available at the office of DNREC – RS or by accessing the DNREC-RS’ site files database. 

The BDA is also part of a settlement agreement with A.M. Domino, Jr. for settlement of the Secretary’s Order issued in 2018, which Mr. Domino, Jr. appealed. The settlement included that the Department shall withdraw Secretary’s Order No. 2018-WH-0054 contingent upon the satisfaction of all of the following conditions:

  1. Conveyance of title to the A.M. Domino Jr. Salvage Co. Site by Owners to RDC;
  2. Reimbursement by Owners to DNREC of $4,117.00 of accrued oversight costs upon conveyance of title to the Site by Owners to RDC;
  3. Agreement by RDC to enter into a BDA with DNREC prior to conveyance of title to the Site by Owners to RDC; and
  4. Acknowledgement by RDC that available Brownfields grant funding has been reduced by the sum of $107,322.91 already expended at the Site.
