The Department of Natural Resources and Environmental Control has proposed amendments the Outer Continental Shelf Air Regulations to incorporate changes to federal regulations. (Public Comment Period Closed)
Delaware’s Outer Continental Shelf Air Regulations (7 DE Admin. Code 1150) regulate air emissions from all sources within the Outer Continental Shelf (OCS). For Delaware, the OCS is the area that is within 25 miles of Delaware’s coastal boundaries along the Atlantic Ocean. This means that air emissions from within the OCS are regulated in the same manner as if the source was located on Delaware’s land.
Delaware’s regulations were promulgated in 2010 under the US EPA’s regulations (40 CFR Part 55). The proposed changes to Delaware regulations incorporate recently finalized updates to the EPA regulations.
Persons wishing to comment on the proposed amendments may do so either orally or in written form at the public hearing on May 22, 2019. The hearing record will open on May 1 and will remain open for receipt of comment through the close of business on Thursday, June 6, 2019. In lieu of attending the public hearing, written comments may be submitted to the Hearing Officer via email or via USPS at the address below.
