Regulations Governing Hazardous Substance Cleanup. The aforementioned Regulations include the Brownfields Development Program, which is intended to provide liability protection to parties who did not cause or contribute to a release of hazardous substance on a real property. The intent of the proposed amendments is to clarify the distinction between a ‘certified brownfield’ and a ‘facility’.
