The Environmental Appeals Board will hold oral arguments on initial motions regarding four appeals related to a proposal to construct a new container port on the Delaware River.

The appeals challenge the decision of the DNREC Secretary in Secretary’s Order No. 2021-W/CCE-0026, dated Sept. 30, 2021. They were filed by:

• Delaware Community Benefits Agreement Coalition, et al (EAB 2021-07)
• The Philadelphia Regional Port Authority (EAB 2021-08)
• The Port Operators (EAB 2021-09)
• Walter F. Curran (EAB 2021-10)

Oral Argument on motions in limine are scheduled for Sept. 13, 2022, at 9 a.m. An Environmental Appeals Board hearing on these appeals is scheduled for Oct. 11, 2022, at 9 a.m.
