Permit Application

Notice has been given that:

Colors and Effects USA, LLC. (Formally BASF Colors and Effects USA, LLC.), requests a permit to construct a limited term, 99.83 MMBtu/hr boiler at their 205 South James Street, Newport Delaware facility. The boiler will be permitted to emit 4.99 Tons of Nitrogen Oxides (NOx), 10.27 Tons of Carbon Monoxide (CO), 1.39 Tons of Particulate Matter (PM), 0.55 Tons of Volatile Organic Compounds (VOC), and 0.08 Tons of Sulfur Oxides (SOx) by Permit: APC-2022/0047 – CONSTRUCTION.

The application for this permit may be reviewed upon request. The application is posted at de.gov/dnrecnotices. To submit comments, for additional information or for information regarding how you can inspect the application, please contact Tracy Mattson at (302) 739‑9402.

A public hearing on any of the above applications will NOT be held unless the Secretary of DNREC receives a request for a hearing regarding that application within 15 days from the date of this notice, ending January 10, 2022. A request for a hearing shall be in writing. The request must also show a familiarity with the application and a reasoned statement of the permit’s probable impact.
