Agricultural Utilization Permit Renewal: Denali Water Solutions

Denali Water Solutions, LLC. (Denali) of Keymar, Maryland is permitted, under State Permit Number AGU 1702-K-05, to operate a land treatment system for the agricultural utilization of dissolved air flotation (DAF) solids and other land treatable residuals as approved by the Department of Natural Resources and Environmental Control (Department). Solids are generated from approved locations and may be applied onto nine currently permitted application farms in Delaware under Part V of the Department’s Guidance and Regulations Governing the Land Treatment of Wastes. Denali has requested the renewal of the aforementioned AGU permit and the addition of a tenth application site known as the Luff Farm.

Land treatable residuals managed by Denali consist of residuals generated from chicken and pet food processing facilities during the treatment of process wastewater. Land treatable residuals can be beneficially reused as a fertilizer since they contain nutrients which are essential for agricultural crop production. After applying an appropriate amount of land treatable residual to a farm field, crops are planted and grown utilizing these nutrients. Land treatable residuals applied by Denali are required to be analyzed for a list of parameters including nutrient content prior to land application. The land treatable residuals applied by Denali do not contain sanitary (human) waste and are permitted for application no more than once every three years on any one permitted area. Land treatment residuals are required to be transported to storage facilities and the land application sites in accordance with a valid Delaware Non-Hazardous Liquid Waste Transporters Permit.

Under the current AGU permit, DAF and other Department approved land treatable residuals may be applied at agronomic rates onto 9 permitted farms located within an 8-mile radius of Harrington Delaware. The farms comprise a total of approximately 1,500 acres of land that is suitable for land application. Upon permit renewal, the Luff Farm will be added to the AGU permit. The Luff Farm application site consists of approximately 91 acres of land suitable for land application and is located southwest of the intersection of High Stump Road and Greenville Road, approximately 6 miles southwest of Harrington, Delaware.

Denali Water Solutions, LLC. has requested that their existing permit (State Permit Number AGU 1702-K-05) to operate a land treatment system for the agricultural utilization of DAF and other Department approval land treatable residuals, under Part V of the Department’s Guidance and Regulations Governing the Land Treatment of Wastes, be amended and renewed.

Part V of the Department’s Guidance and Regulations Governing the Land Treatment of Wastes allows for such activity pending public notice.

A public hearing on the above application will NOT be held unless the Secretary of the Department determines that a public hearing is in the public interest or if a written meritorious objection to the application is received by 4:30 p.m. February 29, 2022. A public hearing request shall be deemed meritorious if it exhibits a familiarity with the application and provides a reasoned statement of the action’s probable impact.
