The Hazardous Substance Cleanup Act (HSCA), 7 Del. C. § 9107 (a)(1), requires the Department of Natural Resources and Environmental Control (DNREC) to provide “public notification within 20 days after entering into negotiations for a voluntary cleanup settlement agreement with any person that agrees to perform a remedy.”

As required by § 9107 (a)(1), DNREC advises that it is negotiating a Voluntary Cleanup Program (VCP) Agreement with Fox Run SC, LLC regarding the Fox Run Shopping Ctr-Unit 120 Site (DE-1809) located at Fox Run Shopping Center, Unit 120, Bear, DE. The Site is identified as portions of New Castle County tax parcel number 11-028.00-068. The Site requires remedial action due to historic activities on site.
