NRG Energy Inc., Indian River Generating Station – Industrial Landfill Permit Renewal

Pursuant to 7 Del. C., Section 6004, notice is hereby given by the Department of Natural Resources and Environmental Control’s (DNREC) Division of Waste and Hazardous Substances (WHS), Compliance and Permitting Section (CAPS) that NRG Energy Inc.’s (NRG) Solid Waste Permit (SW-12/01) for the Indian River Generating Station (IRGS) Industrial Waste Landfill at 29416 Power Plant Road in Dagsboro, Delaware is being renewed by the CAPS.

The NRG Industrial Landfill permit renewal titled: NRG, Indian River Generating Station, Permit Renewal Application Request, Permit SW-12/01, requests that the industrial waste landfill continue to accept non-hazardous coal fly ash, non-hazardous coal bottom ash, non-hazardous air emission control flue gas byproduct and non-hazardous industrial wastes from the IRGS. The permit renewal application does not include any modifications to the landfill or expansion of the landfill.

The permit application is available for review during business hours at DNREC’s Compliance and Permitting Section office at 89 Kings Highway in Dover. A link to the documents is also available on-line at: dnrec.delaware.gov/dnrec-public-notices/

A public hearing on the above permit renewal will NOT be held unless the Secretary of DNREC receives a meritorious request within fifteen (15) days from the date of this notice (September 6, 2022). A request for a hearing shall be in writing and shall state the nature of the issues to be raised at the hearing. It must also show a familiarity with the application and a reasoned statement of the activity’s probable impact.
