Title V Modification Applications

The Department of Natural Resources and Environmental Control, Division of Air Quality, is reopening for cause the Title V permits for the following facilities:

  • Energy Center Dover, LLC’s Permit: AQM-001/00127-(Renewal 4)(Revision 2), and the associated 1102 Permit: APC-2000/0256-OPERATION (A-2) (NSPS) (PSD-GHG) (FE), Permit: APC-2011/0154-OPERATION (FE) (Amendment 1), and Permit: APC-2000/0256-OPERATION (NSPS) (PTE) (Amendment 1).
  • Warren F Beasley Power Station (DEMEC)’s Permit: AQM-001/00152-(Renewal 3)(Revision 2), and the associated 1102 Permit: APC-2001/0293-OPERATION (Amendment 3) (NSPS) (PTE).
  • Calpine Mid-Atlantic Generation – Edge Moor’s Permit: AQM-003/00007-(Renewal 3)(Revision 1), and associated 1102 Permit: APC-1983/0826-OPERATION (AMENDMENT 5) (EOP) (PSD) (NSPS) (NOx RACT).
  • Calpine Mid-Atlantic Generation – Hay Road’s Permit: AQM-003/00388-(Renewal 3)(Revision 1) and associated 1102 permits. Permit: APC-2015/0027-OPERATION (AMENDMENT 1)(EOP/PSD)(FE), Permit: APC-2015/0028-OPERATION (AMENDMENT 1)(EOP/PSD)(FE), Permit: APC-2014/0062-OPERATION (AMENDMENT 1)(PTE)(FE), Permit: APC-88/0127-OPERATION(AMENDMENT 6)(PSD)(NSPS)(NOx RACT), Permit: APC-88/0128-OPERATION(AMENDMENT 6)(PSD) (NSPS) (NOx RACT), and Permit: APC-90/0152-OPERATION(AMENDMENT 5)(PSD)(NSPS)(NOx RACT)

The Department is also updating the following 1102 permits for Calpine Mid-Atlantic Generation’s Peaking Units whose Title V permits were modified in May 2021.

  • Calpine Mid-Atlantic Generation – Christiana Energy Center’s Permit: APC-1982/0774-OPERATION (Amendment 6), and Permit: APC-1982/0775-OPERATION (Amendment 6).
  • Calpine Mid-Atlantic Generation – Delaware City Energy Center’s Permit: APC-82/0141-OPERATION (AMENDMENT 4).
  • Calpine Mid-Atlantic Generation – West Energy Center’s Permit: APC-1980/0379-OPERATION (Amendment 4).

in accordance with the procedures of 7 DE Admin. Code 1130. The “draft/proposed” minor permit modifications will incorporate new operation standards to meet the requirements of the Mid-Atlantic Northeast Visibility Union (MANE-VU), Regional Haze emission management strategies. There will be no changes to the Facilities air emissions.

The “draft/proposed” minor permit modifications and a copy of a summary of other materials, if any, considered in preparing the “draft/proposed” significant permit modifications may be reviewed upon request. The application is posted at de.gov/dnrecnotices. The “draft/proposed” permit renewal is being submitted to EPA for concurrent processing. If there are no significant comments, the “draft/proposed” permit renewal will be issued as a final permit after expiration of the EPA review period.

A public hearing concerning the permitting action will not be held unless the Secretary of the Department of Natural Resources and Environmental Control receives a request for such hearing within thirty (30) days from the date of this notice, ending February 14, 2022. A request for a hearing shall be in writing and must show a familiarity with the application and a reasoned statement of the Minor Permit Modification’s probable impact.
