Notice is hereby given that JP Morgan has submitted an application, pursuant to 7 DE Admin. Code 1102, Section 2.1, 11.2.9, and 12.3 for a permit amendment to remove SCR systems from four emergency generators located at their 501 Bear Christiana Road, Newark facility.

JP Morgan requests permission to limit the hours of operation for each emergency generator at the facility to 124 hours per year. These limits are necessary to restrict JP Morgan’s potential to emit air pollutants, and the limit will be enforceable by the EPA and the state. Facility wide permitted emissions will not increase as a result of this amendment. Emissions from each of the four generators will be 35.66 lb/hr of NOX, 3.01 lb/hr of CO, 0.01 lb/hr of SO2, 0.55 lb/hr of total hydrocarbons, and 0.30 lb/hr of PM10. Facility wide emissions will be limited to 25.37 tons/year of NOX, 2.88 tons/year of CO, 0.26 tons/year of SO2, 1.57 tons/year of total hydrocarbons, and 0.45 tons/year of PM10.

The application, the “draft” permit APC-2003/0285-OPERATION(SM)(NSPS)(A5) all materials that the applicant has submitted (other than those granted confidential treatment under DNREC rules), and a copy or summary of other materials, if any, considered in preparing the “draft” permit may be inspected upon request. The application is posted at de.gov/dnrecnotices. A public hearing concerning the permitting action will not be held unless the Secretary of the Department of Natural Resources and Environmental Control receives a request for such hearing within thirty (30) days from the date of this notice, ending January 11, 2022. A request for a hearing shall be in writing and must show a familiarity with the application and a reasoned statement of the permit’s probable impact.
