Subaqueous Lands Permit Application

David Failor (134-7.00-26.01) – To install a 4 by 25 foot long dock, a 3 by 10 foot long gangway and a 4 by 15 foot long floating dock in an unnamed lagoon adjacent to Lot 5 on Kent Road, Indian River Acres, Dagsboro, Sussex County, DE

Delaware Department of Transportation (adjacent to 0701100035) – To replace an existing 36-inch pipe and associated retaining wall structures, install two (2) new 60-inch and 15-inch diameter pipes, and to place 23 cubic yards of rip-rap, resulting in 496 square feet of temporary open water impacts and 1,398 square feet of permanent open water impacts to an unnamed tributary to Red Clay Creek, Old Kennett Road, Wilmington, New Castle County, DE

Hometown Rehoboth, LLC (3-34-19.00-1.01), (2-32-9.00-19.00-disposal) – To mechanically maintenance dredge 578 cubic yards of material from tidal swales along White Oak Drive, Hometown Rehoboth, Rehoboth Beach, Sussex County and to dispose of the material at the Jones Crossroad Landfill facility located at 28560 Landfill Lane, Georgetown, Sussex County, DE. Additionally, to place 57 cubic yards of fill (topsoil) during the grading of the swale and to repair by replace eight (8) existing HDPE stormwater drainage pipes and to install approximately 40 total cubic yards of rip-rap for outfall protection in an unnamed tributary adjacent to White Oak Creek at White Oak Drive, Hometown Rehoboth, Rehoboth Beach, Sussex County, DE

A public hearing on the above applications will NOT be held unless the Secretary of DNREC determines that a public hearing is in the public interest or if a written meritorious objection to the application is received within 20 days from this notice.  Please indicate in your letter whether your intention is to request a public hearing or whether you are simply providing comments for the Department’s consideration. If a public hearing is desired, please be advised that a public hearing request shall be deemed meritorious if it exhibits familiarity with the application and provides a reasoned statement of the action’s probable impact.
