South Shore Moorings, LLC (1-34-2.00-3.00, 1-34-7.00-126.01-Disposal) – To mechanically maintenance dredge approximately 3,281 cubic yards of material to -5.3 feet below MLW in the Indian River Inlet at the entrance channel of the South Shore Marina located adjacent to Marina View Court in Bethany Beach, and to transport dredged material via water-tight trucks to an off-site, upland disposal area located adjacent to Irons Lane in Dagsboro, Sussex County, DE

Statewide Activity Approval (SAA) Renewal

The Division of Water, Department of Natural Resources and Environmental Control (Department) proposes to revise and renew a Statewide Activity Approval (SAA) for Shellfish Aquaculture in specific, designated “Shellfish Aquaculture Development Areas (SADA)”. This Statewide Activity Approval (SAA) may be used to authorize shellfish aquaculture activities within specific portions of the SADA previously established by the Division of Fish and Wildlife under 7 DE Admin Code 3800 Shellfish Aquaculture Regulations. The areas include Indian River Bay (IR-A), Rehoboth Bay (RB-A, RB-B, RB-C), and Little Assawoman Bay (LA-B and LA-D), specifically. The intent of the SAA is to facilitate the issuance of subaqueous lands permits in these specific areas in support of the Division of Fish and Wildlife’s commercial shellfish aquaculture program.

Subaqueous Lands Permit, Wetlands and Water Quality Application

Division of Watershed Stewardship (5-00-12400-01-0300-00001 & 5-00-12400-01-0200-00001) – Requests for a Section §401 Water Quality Certification. Approval is being requested to impact 35,800 square feet of state-regulated tidal wetlands associated with hydraulically removing approximately 88 cubic yards of accumulated sediment from a drainage ditch and broadcasting spoils across State-regulated wetlands, located adjacent to South Bowers Road in Milford, Sussex County, DE

A public hearing on the above applications will NOT be held unless the Secretary of DNREC determines that a public hearing is in the public interest or if a written meritorious objection to the application is received within 20 days from this notice. Please indicate in your letter whether your intention is to request a public hearing or whether you are simply providing comments for the Department’s consideration. If a public hearing is desired, please be advised that a public hearing request shall be deemed meritorious if it exhibits familiarity with the application and provides a reasoned statement of the action’s probable impact.
