Types of Enforcement Orders



DNREC enforcement-related orders may entail one or more of the following types of documents, or a combination of them.

Notice of Administrative Penalty Assessment

A Notice of Administrative Penalty Assessment sets out the facts, background and findings of violations, and gives notice that the Department intends to assess a monetary penalty based on those violations.

Notice of Conciliation

A Notice of Conciliation sets out the facts, background and findings of violations, and prescribes actions a violator is required to take in order to come into compliance.

Secretary’s Order

A Secretary’s Order relating to enforcement orders the violator to take steps to correct violations by a deadline set in the Order.

Cease and Desist Order

A Cease and Desist Order instructs a violator to cease the offending conduct or activity immediately.

Imminent Hazard Order

An Imminent Hazard Order is used when there is an imminent threat to human health or the environment, involving the transportation, treatment or disposal of hazardous wastes. This type of order directs owners/operators of hazardous waste facilities or sites to eliminate the threat or practice which constitutes the hazard in a prescribed amount of time.
