Title V Fee Committee



The Title V Operating Permit Program Advisory Committee, generally known as the Title V Fee Committee, was established by the Delaware General Assembly (7 Del. Code, § 6099) to provide guidance for the Title V: Major Sources program and to publish an annual report on costs and fees related to the Title V permitting program.

Committee Membership

Title V of the Federal Clean Air Act Amendments requires that facilities subject to the program pay an annual fee sufficient to cover all reasonable direct and indirect costs associated with administering the Title V permit program. Within the State of Delaware, the fees are set in state code in 7 Del. Code § 6097.

The Title V Fee Committee conducts an annual review of the program and works to propose fee schedule updates on a periodic basis for approval by the Delaware General Assembly. The most recent update applies to calendar years 2024 through 2026 and was approved by the legislature in 2023 (84 Del. Laws, Chapter 104 ). The Title V fee schedule is set in state code in 7 Del. Code § 6097.
