Motiva Enterprises, LLC – Industrial Waste Landfill Permit Modification AND Fly Ash Settling Ponds Permit Modification

Notice is hereby given by the Department of Natural Resources and Environmental Control’s, Compliance and Permitting Section (CAPS) that Motiva Enterprises, LLC (Motiva) has completed closure activities for the Industrial Waste Landfill (IWL) (SW-04/01) and the Fly Ash Settling Ponds (FAP) (SW-96/01), located on the grounds of the Delaware City Refinery in Delaware City at 4550 Wrangle Hill Road, Delaware City, in accordance with Delaware’s Regulations Governing Solid Waste (DRGSW).  The existing permits for the IWL and FAP are being transitioned into Post-Closure Care Permits by the CAPS.

A copy of the IWL Construction Certification Report, IWL Post-Closure Care Plan, draft IWL Post-Closure Care Permit, FAP Construction Certification Report, FAP Post-Closure Care Plan, and a draft FAP Post-Closure Care Permit are available for review during business hours at DNREC’s Compliance and Permitting Section office at 89 Kings Highway in Dover or at the Bear Public Library at 101 Governors Place in Bear.  The documents are also available online at: http://www.dnrec.delaware.gov/dwhs/shwmb/pages/solidwastefacilities.aspx.  For additional information or an appointment to review the application, please contact Alison Kiliszek, WHS/CAPS, 89 Kings Highway, Dover, DE 19901, 302-739-9403 or Alison.Kiliszek@delaware.gov.

A public hearing on the above permit modifications will NOT be held unless the Secretary of DNREC receives a meritorious request within fifteen (15) days from the date of this notice (August 26, 2019).  A request for a hearing shall be in writing and shall state the nature of the issues to be raised at the hearing.  It must also show a familiarity with the application and a reasoned statement of the activity’s probable impact.
