The Delaware Department of Natural Resources and Environmental Control, Division of Water, Groundwater Discharges Section, hereby gives notice of the following proposed application and draft permit.

Artesian Wastewater Management, Inc. has applied to amend their State of Delaware On-Site Wastewater Treatment and Disposal System Operations Permit No. 202221-02. The permit authorizes the operation and maintenance of the Stonewater Creek Wastewater Treatment & Disposal Facility to receive and treat domestic wastewater from Sussex County and Artesian’s regional wastewater system. Up to 450,000 gallons per day (gpd) of treated wastewater is discharged to six (6) rapid infiltration basins (RIBs) for final disposal. The amendment authorizes treated wastewater from Sussex County’s Inland Bays Wastewater Treatment & Disposal Facility to be discharged into Stonewater Creek’s RIBs and for wastewater to be pumped from Stonewater Creek to the Inland Bay’s facility for treatment and the treated wastewater being pumped back to Stonewater Creek for final disposal in the RIBs. The Stonewater Creek Treatment & Disposal Facility is located at 24199 Indian Mission Road, Long Neck, Sussex County, Delaware (tax map # 2-34-16.00-19.00).

Based on a preliminary staff review and application of lawful standards and regulations, the Department proposes to amend this permit, subject to certain effluent limitations and operational, monitoring, and reporting conditions. The proposed determinations are tentative. Persons wishing to comment upon or object to the proposed determinations are invited to submit same in writing to the Groundwater Discharges Section of the Division of Water, at the address listed below, no later than 15 days from this notice. All comments received prior to said date will be considered in the formation of final determinations regarding this application.

A public hearing on the above will NOT be held unless the Secretary of the Department receives a request by 4:30 pm June 29, 2020, or if the Secretary determines that a public hearing is in the public interest. A request for a hearing shall be in writing and shall state the nature of the issues to be raised at the hearing. It must also show familiarity with the proposal and a reasoned statement of the permit’s probable impact.
