Groundwater Discharges Rural Area Waiver

Jeffrey Melvin (Tax # MN 193.00-01-29.00) has applied for a Rural Area Waiver (RAW) pursuant to Section 5.6.3 of The Regulations Governing the Design, Installation and Operation of On-Site Wastewater Treatment and Disposal Systems.  The request is being made to allow a system to be placed on land that does not meet current soil limiting zone criteria required by the Regulations Governing the Design, Installation and Operation of On-Site Wastewater Treatment and Disposal Systems in Delaware.

The 23.6-acre parcel is located off Gingerwood Drive and Andrewville Road, Greenwood, Delaware.  The proposed on-site wastewater treatment and disposal system (OWTDS) is an elevated sand mound to be located along the east side of Gingerwood Drive.  Advanced treatment meeting performance standard nitrogen level 3 (PSN3) is not being proposed as part of the OWTDS design.  The proposed OWTDS would serve a single family, three bedroom, dwelling with a design flow rate not to exceed 360 gallons per day.  In addition, as part of the RAW the owner has requested relief from Section 5.6.3.1.5.6 which requires that the proposed disposal location be located a minimum of 100 feet from all property boundaries, when soil conditions allow.  The owner requests a reduction to a minimum of 50 feet setback from adjacent property lines for the location of the proposed elevated sand mound.

A public hearing on the above applications will NOT be held unless the Secretary of DNREC determines that a public hearing is in the public interest or if a written meritorious objection to the application is received within 15 days from this notice.  A public hearing request shall be deemed meritorious if it exhibits a familiarity with the application and provides a reasoned statement of the action’s probable impact.
