Agricultural Utilization Permit Renewal – Kent County Levy Court (Delaware)

Kent County Levy Court currently has requested renewal of one of their existing agricultural utilization (AGU) permits (State Permit Number AGU 1603-K-03). The existing permit authorizes the application of treated biosolids generated at the Kent County Regional Wastewater Treatment Facility that have undergone a “Process to Significantly Reduce Pathogens” onto land suitable for biosolid application and crop production.

The aforementioned AGU permit is for a parcel of farmland in Kent County comprising a total of approximately 120 acres located approximately 1 mile southwest of Frederica Delaware and is known as the Vineyard Farm. Should biosolids be applied onto the Vineyard Farm, all biosolid will be delivered to the site in accordance with Delaware Waste Transporters Permit No. OH-11 and will be land applied at agronomic rates.

Notice is hereby given that Kent County Levy court has submitted a permit application requesting that their existing agricultural utilization permit for the land treatment of biosolids at the Vineyard Farm be renewed under the Department’s Guidance and Regulations Governing the Land Treatment of Wastes, Part III, B., Regulations Governing the Land Treatment of Sludges and Sludge Products which allows for such activity pending public notice.

A public hearing on the above application will NOT be held unless the Secretary of DNREC determines that a public hearing is in the public interest or if a written meritorious objection to the application is received by 4:30 p.m. November 10, 2021. A public hearing request shall be deemed meritorious if it exhibits a familiarity with the application and provides a reasoned statement of the action’s probable impact.
