Subaqueous Lands Lease

Hearn Group, LLC – to construct a 3 by 70 foot long walkway over federally regulated wetlands, a 3 by 150 foot long wetland walkway over state-regulated tidal wetlands, a 4 by 45 foot long pier, a 6 by 20 foot long dock, two (2) boat lifts with four (4) associated pilings each and two (2) 5 by 12 foot long floating PWC docks in the Nanticoke River located at 26762 River Road, Seaford, Sussex County, DE.

Glenn Horenberg – to repair by replace a 6 by 25 foot long dock, to construct a 6 by 15 foot long extension, and to install a single-piling PWC lift, in the Little Assawoman Bay, at 1206 N. Shultz Road, Fenwick Island, Sussex County, DE.

Subaqueous Permit and Water Quality Certification Request

Town of Fenwick Island – proposes to hydraulically dredge approximately 19,000 cubic yards of material in the north and south channels of the Little Assawoman Bay in Sussex County, Delaware to a depth of -4 feet mean low water with a 1-foot allowable over-dredge. The combined channel length would be approximately 4,000 linear feet and the combined surface area would be approximately 4.6 acres. Dredged material would be transported via pipeline to an upland placement area (533-20.00-20.00) west of the Bay. Additionally, the applicant requests for a Section §401 Water Quality Certification. Approval is being requested to conduct dredging in the north and south channels of the Little Assawoman Bay.

A public hearing on the above applications will NOT be held unless the Secretary of DNREC determines that a public hearing is in the public interest or if a public hearing request is received within 20 days from this notice.  Please indicate in your letter whether your intention is to request a public hearing or whether you are simply providing comments for the Department’s consideration. If a public hearing is desired, please be advised that a public hearing request shall be deemed meritorious if it exhibits familiarity with the application and provides a reasoned statement of the action’s probable impact.
