Sussex Conservation District (533-11.00-98.01 and 98.02) – To remove up to 366 cubic yards of material, to place 3.15 cubic yards of fill and up to 209 cubic yards of rip-rap for bank stabilization along a 394 linear foot long section of streambank in Bear Hole Tax Ditch, at 37044 and 37050 Johnson Road, Selbyville, Sussex County, DE

Southern Delaware Botanic Gardens, Inc (233-6.00-116.10) – To stabilize the shoreline and conduct wetland enhancements by constructing the following four phases: Phase 1 to include 318 linear feet of anchored branch toe.  Phase 2 to restore vegetative communities by planting ≈ 30 clusters of 15 wetland plugs each and to create a pollinator grove by installing ≈ 8 inverted root wads with triad plant clusters, ≈ 7 shrub triad plant clusters and 9 herbaceous triad plant clusters across 5,652 square feet channelward of MHW and a portion in State-regulated wetlands.  Phase 3 to restore vegetative communities by planting ≈ 350 wetland plugs across 655 square feet channelward of MHW and a portion in State-regulated wetlands.  Phase 4 to restore vegetative communities by installing 3 root wads, to fill with 4 cubic yards of sand in barren areas and to plant ≈ 500 wetland plugs across 544 square feet channelward of MHW and a portion in State-regulated Wetlands located in Pepper Creek at the Delaware Botanic Gardens, 30220 Piney Neck Road, Dagsboro, Sussex County, DE

Sumner and Bonnie Crosby (3-35-4.18-90.00) – To maintain three 2 by 14 foot long piers and twelve stand-alone piles in Lewes and Rehoboth Canal, at 558 Pilottown Road, Lewes, Sussex County, DE

A public hearing on the above applications will NOT be held unless the Secretary of DNREC determines that a public hearing is in the public interest or if a written meritorious objection to the application is received within 20 days from this notice.  Please indicate in your letter whether your intention is to request a public hearing or whether you are simply providing comments for the Department’s consideration. If a public hearing is desired, please be advised that a public hearing request shall be deemed meritorious if it exhibits familiarity with the application and provides a reasoned statement of the action’s probable impact.
