Questions and comments are always welcome as regulations are developed, but every regulatory development will include formal commenting processes such as workshops and public hearings. Comments meant to be considered as part of the official record must be made as part of the public hearing process.

The Division of Waste and Hazardous Substances proposes a new regulation to codify screening and reporting level tables used in site remediation planning under the Delaware Hazardous Substances Cleanup Act (7 Del.C. Ch. 91).
This regulation will provide screening and reporting level values for hazardous substances that are identified and quantified in accordance with § 9104 of the Act to protect public health, or welfare, or the environment.
This regulatory amendment process started with DNREC Start Action Notice 2024-04.
The Division of Waste and Hazardous Substances proposes to amend Delaware’s Underground Storage Tank Systems regulations (7 DE Admin. Code 1351).
The purpose of this action is to update reference standards noted in the regulation, reorganize and consolidate for clarity and efficiency, and make changes to reflect advances in underground storage tank system technology.
This regulatory amendment process started with DNREC Start Action Notice 2024-03.
The Division of Waste and Hazardous Substances proposes to amend Delaware’s Regulations Governing Solid Waste (7 DE Admin. Code 1301).
The objectives of revising the Regulations are to increase the protection to human health and the environment by modifying outdated and/or obsolete regulatory language, clarifying existing regulatory language, adding clarifying language, and correcting typographical and grammatical errors.
The Division held a public workshop for discussions about the proposed changes with key stakeholders and interested members of the public in April 2023.

The Division of Waste and Hazardous Substances proposes to amend Delaware’s Regulations Governing Hazardous Substance Cleanup (7 Delaware Admin. Code 1375).
The purpose of this action is to amend regulatory requirements that will improve clarity and consistency for the regulated community, incorporate new industry concepts associated with improved scientific techniques, cultivate public involvement, and integrate requirements to strengthen environmental initiatives that will improve human health and the environment.
This regulatory amendment process started with DNREC Start Action Notice 2023-06.
The Compliance and Permitting Section proposes to modify the scrap tire regulatory requirements in the Regulations Governing Solid Waste (7 DE Admin. Code 1301) to eliminate redundancy of regulation with other programs, clear up inconsistencies, address scrap tire retreading and make changes in organization and structure to improve readability. The amendments will include corrections to ensure consistency with the Delaware Administrative Code Drafting and Style Manual.
This regulatory amendment process started with DNREC Start Action Notice 2023-05.
The Hazardous Waste Program proposes to update the Regulations Governing Hazardous Waste (7 DE Admin. Code 1302) in response to changes in the federal law.
The Hazardous Waste Program, in the Division of Waste and Hazardous Substances, acts as a delegated agency and is responsible for implementing federal requirements. As a result, when changes to the law occur at the federal level, the state is responsible for making the same changes to its regulations.
This regulatory update process began with Start Action Notice 2023-02.
The Division of Waste and Hazardous Substances proposes to amend the infectious waste regulatory requirements (Section 11.0 Part 1) in the Regulations Governing Solid Waste (7 DE Admin. Code 1301).
Proposed changes include reorganization to improve clarity and applicability, updating outdated and obsolete language and eliminating contradictory language.
This regulatory update process began with Start Action Notice 2021-08.
